FOR PROTECTION AGAINST NATURAL AND OTHER DISASTERS

Kosovo Assembly,

Based on Chapter 9.1.26 (a) and 5.5 (a) of the Constitutional Framework for Provisional Self-Government in Kosovo (UNMIK Regulation nr. 2001/9) dated 15.05.2001,

For the purpose of deciding the legal rules on protection against natural and other disasters,

Hereby adopts the following:

LAW FOR PROTECTION AGAINST NATURAL AND OTHER DISASTERS

I. GENERAL PROVISIONS

Article 1

The Aim

1.1. This law regulates protection and rescue of people, animals, property, cultural and natural inheritance against any natural and other disasters.

1.2. The objective of protection against any natural and other disasters is prevention and reduction of the disasters as well as inhibition and reduction of victims and other consequences.

1.3. Government and Municipalities organize the prevention and rescue against natural and other disasters, as a compact and entire system in Kosova.

1.4. The system of protection and rescue under paragraph 3 of this Article consists of program, organization, implementation, supervision and financing the measures and activities concerning prevention against natural and other disasters.

Article 2

The essential task of the system for protection and rescue against natural

and other disasters

The essential task of the system for protection and rescue against natural and other disasters, according to this Law, are the following:

i.       Detection, observation and investigation of risks that derive from natural and other disasters.

ii.       Inhibition (prevention) of natural and other disasters.

iii.      Reviewing, notification, alarming and informing the citizens for possible risks and giving instructions for protection, rescue and assistance.

iv.      Education and training for protection, rescue and assistance.

v.       Organizing of Protection and Emergency Preparedness and other ways of protection, rescue and assistance.

vi.      Self-protection, self-assistance and mutual assistance (herein after: personal and mutual protection).

vii.     Activation of forces for protection and rescue, and means for implementing protective measures.

viii.     Rescue and assistance.

ix.      Avert of consequences from natural and other disasters and providing elementary life conditions.

x.      Supervising the implementation of regulations for protection and rescue from natural and other disasters.

xi.      Management of international aid in case of natural and other disasters.

Article 3

Definitions

Terms used in this Law are defined as follows:

i. Civil Protection (herein after: CP), is an organized part of the system for protection from natural and other disasters. Civil Protection includes managing authorities, units and services, tools and equipments for protection, rescue and aid.

ii. Emergency Preparedness (herein after EP) means planning, organizing and execution of the necessary measures for emergency actions of relevant central and municipal authorities, including emergency services for prevention, reduction and facilitation of damages caused to people, property or environment from natural and other disasters.

iii. Disaster is an event which is caused by uncontrolled natural and other forces that risk life and health of people, animals and property, causing damages to cultural and natural heritage and environment, where particular forces and tools are needed to manage them.

iv. Natural disasters are: earthquake, floods, avalanches, heavy snow, strong wind, hail, ice, drought, massive appearance of contagious diseases on people, animals and plants as well as other disasters, which are caused by the nature itself.

v. Other disasters are: heavy traffic accidents, air and railway traffic, fire, mine accidents, damage of dams and other ecological and industrial disasters, which are caused by human beings, due to their work and behavior, extraordinary emergent situations high temperature, technical collapse of the energy system with power supply, telecommunication and informative technology, terrorist acts and other types of massive risks.

vi. Preventive measures are those measures that are undertaken prior a disaster occurs in order to avoid or reduce the damages that may derive from that occurrence.

vii. Cultural heritage means cultural premises and their parts, devices, ground surfaces, dwellings and their parts, other forms, which are created by people and nature and real estate of cultural heritage.

viii. Mobilization contains activities, by which protection, rescue and aid forces are placed in a readiness position for accomplishing activities in emergency cases.

ix. Activating consists of activities and devices for search-rescue and protection.

x. Protection, rescue and aid forces are human capacities, which are available for public enterprises, municipalities and government authorities, which are designated for rescue and aid in case of natural and other disasters.

xi. Plan for protection, rescue and aid against natural and other disaster are documents for protection, rescue and aid in case of natural and other disasters, which is designated based on the risk assessments and other protection, rescue and aid forces documents.

xii. Risk assessment means quantitative analysis and specifics concerning the nature and other circumstances for possible occurrence of natural and other disasters.

xiii. Emergency reaction means accomplished activities in case of natural and other disasters by central and municipal authorities and emergency services in reduction and damage alleviation, which occurred to people, property or environment.

xiv. Emergency services mean those services which are provided by: Kosovo Protection Corps, Kosovo Police Service, Hospital and Pre-hospital Emergency Service of Kosovo, Municipal Fire and Rescue Department and Municipal Medical Emergency Services and relevant NGO.

xv. Government authorities means ministries and other competent authorities, established according to the Constitutional Framework and other legal acts.

xvi. Committee for protection against natural and other disasters is a coordinating body of the Municipal Assembly and is established for management of the emergency situations in Municipality.

xvii. Large incidents or emergencies means incidents where additional emergency resources have been required or may be required after the initial mobilization and where is inevitable life threat and total property damages have occurred.

xviii. Catastrophe is occurrence caused by nature or people, every process or event that can cause loss of human lives, and damages of material goods.

xix. Risk is a very serious, real and immediate situation that threatens human's life, animals, damage public property, cultural heritage and environment that may be caused by natural and other disasters.

xx. Re-training means measures and actions taken on reinstatement of the previous situation in the affected regions by disasters.

xxi. MDPR - Municipal Directorate for Protection and Rescue.

xxii. DEM - Department of Emergency Management.

xxiii. USAEC - Unique System for Alarming and Emergency Coordination.

II. SUBJECTS OF PROTECTION FROM NATURAL AND OTHER DISASTERS

Article 4

Protection and rescue from natural and other disasters within the frame of the rights and obligations, which are determined by this law, is executed by:

i.    Public services for protection and rescue at central and municipal level

ii.   Enterprises, institutions and other organizations.

iii. Citizens, organized voluntarily in associations, professional associations and other non-governmental associations (hereinafter associations and other non-governmental associations),

iv. Citizens of Kosovo (hereinafter citizens).

Article 5

In the frame of executing protection and rescue against natural and other disasters, international cooperation shall be implemented in conformity with applicable international standards.

Article 6

6.1. All activities of protection and rescue from natural and other disasters are based and accomplished in accordance with principles of the International-Humanitarian Right and International Right for protection of people, animals, cultural heritage and environment from harmful effects of natural and other disasters as well as the International obligations, arising from them.

6.2. Protection and rescue from natural and other disasters are of humanitarian nature.

III. CITIZEN RIGHTS AND OBLIGATIONS

Article 7

7.1. Every citizen has the right for civil protection against natural and other disasters.

7.2. In case of natural and other disasters, rescue and protection of citizens' lives is a priority compared to every other activity of protection and rescue.

Article 8

For protection and rescue against natural and other disasters, citizens are obliged to:

i.     To cooperate with protection, rescue and aid forces,

ii.    To give material means (hereinafter: material obligation),

iii.   To be trained and prepared for personal and reciprocal protection, and

 iv. To perform foreseen measures for protection and rescue from natural and other disasters.

Article 9

9.1. Each person is obliged to assist the other person, whose life or heath is in danger, but not by risking his/her own life.

9.2. If the person is not able to offer assistance, he/she should immediately inform the competent rescue services, the information center or in another manner to give his/her assistance (aid).

Article 10

10.1. Kosovo citizen is obliged to assist the protection, rescue and aid forces, if he/she is not assigned to other obligatory duties determined by this law in conformity with applicable international standards.

10.2. The obligation for participating in protection, rescue and aid forces starts from the age of 18 up to age 65 (for men), respectively 55 years of age (for women).

Article 11

Free from the obligation to participate in protection, rescue and aid forces are:

i.   Citizens, which for health reasons can not accomplish foreseen tasks,

ii.  Pregnant women and mothers with children under age 10,

iii. Single parent with a child under age 10.

Article 12

In protection, rescue and assistance forces in voluntary bases may participate:

i.   Men and women older than 16 years age,

ii.  Mothers with children under the age of 16,

iii. Men and women, whose obligation ceased, according to Article 10,

Article 13

13.1. The systemization of citizens in protection, rescue and aid forces shall be done by MDPR.

13.2. The citizen, who is systemized in protection, rescue and aid forces (hereinafter: member of protection, rescue and aid forces) shall be provided with membership identification card of protection, rescue and aid forces.

13.3. The content, form and issuance of membership identification card of protection, rescue and aid forces shall be regulated by an Administrative Instruction that shall be issued by Ministry of Internal Affairs (herein after MIA).

Article 14

14.1. Citizens who voluntarily and by free will perform protection duties, rescue and aid are systemized in units, services and operative units of other non-governmental associations and organizations.

14.2. Units, services and other operative structures under paragraph 1 of this Article, in emergency cases, accomplish protection duties, rescue and assistance in cooperation with protection, rescue and aid forces.

Article 15

The member of protection, rescue and assistance forces must be trained for performing duties in accordance with the program composed by DEM.

Article 16

16.1. The members of protection, rescue and assistance forces shall be called in:

i.    muster for the systematization

ii.    for initial and additional trainings,

iii.   for practice and other forms of practical training

iv.   Performing protection, rescue and aid duties as well as prevention of consequences from natural and other disasters.

v.    in case of natural and other disasters, the members of protection, rescue and aid forces may be called for service for protection and rescue, until the created situation from natural and other disasters is finalized.

16.2. The member of protection, rescue and aid forces can perform active service in units and services for protection, rescue and aid forces, public services, enterprises, institutions and organizations which perform important services for protection, rescue and aid.

Article 17

17.1. Citizens execute their material obligations by giving the protection, rescue and aid forces their motor vehicles, engines, other material assets, devices, and equipments, energetic sources required for protection, rescue and assistance in case of natural and other disasters.

17.2. A material obligation is also the placement of equipments for monitoring, information and alarm in business buildings and other premises.

17.3. Citizens, who have material obligations cannot prohibit (detain) placement of equipments or remove them, according to paragraph 2 of this Article.

17.4. Legal person can be charged with material obligations, except for protection means or health insurance, respectively for protection, rescue and aid, pursuant to this Law.

Article 18

18.1. Citizens, who are obliged to participate in protection, rescue and aid forces or have material obligations, should show up at the meeting point at determined time, respectively to handle material means pursuant to the call from competent authority.

18.2. If the citizen doesn't appear or doesn't justify his/her non-appearance, MDPR shall issue an order for bringing him/her by force.

Article 19

19.1. Members of protection, rescue and aid forces, while performing their duties in protection, rescue and aid forces, during the training or accomplishment of their material obligations, based on the call from competent authority, have the right in compensation, respectively for the lost profit, for the time of his/her absence at work, due to the accomplishment of certain duties, in a value and conditions that shall be determined by the Government of Kosovo with respective legal act.

19.2. Compensation, based on paragraph 1 of this Article, is made by the employer, who is charged by the entity, depending where the citizen is systemized in protection, rescue and aid forces. If the citizen is systemized in protection, rescue and aid forces alongside with the Employer, then the Employer shall compensate the expenditures of salary.

19.3. If performance of duties and obligations in protection, rescue and aid forces lasts more than 4 hours, then the participant has the right on free meal from the subject that called him/her.

19.4. The employer of the participant of protection, rescue and aid forces, respectively the citizen, who pursuant to this Law participates during accomplishing duties for protection, rescue and aid cannot dismiss the employee or transfer him/her to another work post.

Article 20

20.1. Injury or illness that may occur during performance of duties, training and other material obligations in protection, rescue and assistance forces, shall be treated as injury at the work place or vocational illness and the citizen shall enjoy the rights according to the legal provisions in force.

20.2. Based on the paragraph 1 of this Article, injury is considered even the injury which occurred to the citizen on the way from home or working place to the site of performance or on the way back to his/her home or working place.

20.3. The place and time of injury shall be determined by the authority, or the official for protection, rescue and assistance forces.

20.4. If the citizen dies during performance of duties or other obligations in protection, rescue and assistance forces, then the members of his/her family have the right in pension, expenses, and funeral transportation pursuant to regulations for retirement, invalidity and health insurance.

20.5. Expenses for health, retirement and invalidity insurance shall be covered by the Government, if the citizen is not insured in any other way.

Article 21

21.1. If the citizen during performance of duties or other obligations in protection, rescue and aid forces has been injured not by his fault and the invalidity is at least 20%, then according to regulations of invalidity, he/she has the immediate right for aid in money.

21.2. Based in paragraph 1 of this Article, right in immediate money aid, has also the citizen, gets ill directly from accomplishment of duties or other obligations in protection, rescue and aid forces and his/her and the invalidity reaches the level of 20%.

21.3. If the citizen dies during accomplishment of duties or other obligations in protection, rescue and aid forces based in paragraph 1 of this Article, a right for one time money aid have also other members of his/her family.

21.4. According to paragraph 1, 2, 3 of this Article the Government by an Administrative Instruction determines the amount of aid, which can not be lower than 12 month salaries.

Article 22

22.1. The citizen, which has been damaged during the performance of duties or other obligations in protection, rescue and aid, according to this Article has the right for compensation.

22.2. Citizens and legal persons, who are obliged with material obligations, have the right in compensation for the use of equipment, as well as in compensation if their equipments are damaged or destroyed during actions for protection, rescue and aid.

22.3. Government, with a special act shall determine the type of material means that MDPR defines as material obligation, as well as the amount of compensation related to the usage, the way of determination and damage compensation.

Article 23

23.1. Municipality is responsible for compensation of the damages occurred to individuals, intentionally or due to carelessness, during accomplishment of duties of protection, rescue and aid as well as for accomplishment of training and other activities, related to natural and other disasters.

23.2. The citizen who during accomplishment of duties intentionally or due to negligence has caused damages pursuant to paragraph 1 of this Article shall be legally responsible.

Article 24

MIA by an administrative instruction determines the criteria regarding duties and rights of respective bodies in gathering, processing, using and keeping personal data for members of protection, rescue and aid forces.

IV-COMPETENCES

Article 25

The Government competencies in the field of protection, rescue and aid forces are:

i.       Organization of system for Kosovo protection, rescue and aid forces.

ii.       Adopting of the development projects and research activities for protection against natural and other disasters.

iii.      Conduction of protection, rescue and aid forces in case of natural and other disasters, which may strike two or more municipalities.

iv.      Organization and completion of monitoring, information and alarming in central and municipal level and establishing of the unique alerting system (112).

v.       Organization of the international cooperation in the field of protection against natural and other disasters.

vi.      Decides on engagement of human and material potentials in case of natural and other disasters.

vii.     The Government can decide for requesting and accepting the aid from foreign countries in case of extraordinary natural and other disasters.

viii.     Establishing inter-ministerial committee for rescue and protection.

ix.      The Government shall establish the Fund for intervention in emergency cases.

Article 26

Inter-ministerial committee for protection and rescue

26.1. The Government establishes Inter-ministerial Committee for Protection and Rescue and determines the composition of this committee (hereinafter IMCPR).

26.2. IMCPR shall exist until the elimination of the reasons that caused the emergency.

26.3. IMCPR may call experts for counsel in case of natural and other disasters.

Article 27

The tasks of Inter-ministerial Committee for Protection and Rescue

IMCPR shall perform the following tasks:

i.    In case of natural and other disasters nominates the leader of the operation (incident commander),

ii.    coordinates the activities of protection and rescue forces against natural and other disasters,

iii.   coordinates the management of state resources and determines the manner of using them,

iv.   determine manners and procedures on using material and financial resources in emergency cases,

v.    preliminarily discuses and decides on assessment of damages caused by natural and other disasters,

vi.   evaluates rebuilding and rehabilitation from natural and other disasters, for the purpose of protecting and rescue human life and health, animals, property, cultural environment heritage, and preventing possible damages in the future and providing elementary life conditions,

vii.  performs other tasks, that derive from this law and special tasks determined by the Government in order to face natural and other disasters.

Article 28

Ministry of Internal Affairs

28.1. The Ministry of Internal Affairs shall be responsible for drafting and implementation of plan for protection and rescue against natural and other disasters and performs the following duties:

i.       together with other institutions shall implement the policy of the Government in the field of planning and facing natural and other disasters,

ii.       coordinate actions of all parties in planning and facing natural and other disasters for accomplishing their duties and coordinate work in local government bodies on facing natural and other disasters,

iii.      manage the system for protection against natural and other disasters,

iv.      develop the strategy of planning programs and facing natural and other disasters, and submits them to the Government for adoption,

v.       processes implementation of education and training programs in the field of protection against natural and other disasters,

vi.      in cooperation with the Ministries, institutions and other different local bodies make the assessment of risks on which is based the drafting of general plan for protection and rescue against natural and other disasters in Kosova and submits it to the Government for adoption.

vii.     Undertake measures on self-awareness and consciousness of the citizens in case of natural and other disasters and plans funds for investigation and studying by public institutions for endurance of natural and other disasters,

viii.     Conducts agreement with associations and organizations, which provide with their assistance in accomplishing of duties in planning and facing natural and other disasters,

ix.      According to the need, reports every six months to the Government regarding general situation of planning and facing natural and other disasters,

x.      Provides the IMCPR with all required data on the situation of natural and other disasters and the risks they present,

xi.      Follows the work on establishing and using state resources that are available by the structures of Kosovo potential in cases of natural and other disasters,

xii.     Organizes, implements and monitors the data system in Kosovo level in cases of natural and other disasters,

xiii.    Cooperates the work on evaluation of caused damages and rehabilitation from natural and other disasters, pursuant to relevant sub legal acts,

xiv.    Performs other tasks that derive from this law, other laws and other sub legal acts that regulate this field.

28.2. For accomplishing foreseen tasks for MIA, the Department of Emergency Management (DEM) shall be responsible.

  

Article 29

Ministries

29.1. Each Ministry is responsible for organization of planning and endurance of natural and other disasters in the activity for which is responsible.

29.2. The ministries perform the following tasks:

i.  Draft plans for protection against natural and other disasters, according to their activities and responsibilities and submits them to the Ministry of Internal Affairs for coordination,

ii.  In scope of their responsibilities, implement the plans and determine the measures for prevention of natural and other disasters and consequences from such disasters,

iii. in coordination and consult with the Department of Emergency Management organize trainings and education in scope of their activities,

iv. Analyze the situation of planning and endurance natural and other disasters in the field of their responsibilities and inform the DEM.

Article 30

Public bodies

30.1. Public bodies, when required from the DEM, accomplish the studies that include precaution, prevention and avoidance of consequence of natural and other disasters and present the analyses to the DEM.

30.2. Public bodies also submit to the DEM the study results, which may be in the interest for planning and face natural and other disasters.

30.3. The Government by decision determines the manner of planning and endurance of respective costs.

Article 31

Competences of the Municipality

31.1. Competences of the Municipality in the field of protection of natural and other disasters are:

i.       Survey, information and alarming of population concerning the risk.

ii.       Organization and maintenance of alarm equipment in accordance with the unique system of alarming.

iii.      Organization and functionality of the communication system for protection, rescue and aid in accordance with the unique system of intercommunication.

iv.      Planning and accomplishment of protection measures and rescue.

v.       Risk assessment and protection planning from natural and other disasters.

vi.      Establish the Committee for protection and rescue from natural and other disasters, organization of Committees, units and services of forces for protection from natural and other disasters and other forces of protection, rescue and aid.

vii.     Providing of emergency equipment for temporary shelters in case of natural and other disasters.

viii.     Realization of training programs.

ix.      Unification of plans and other preparations for protection, rescue and aid in neighboring municipalities.

x.      Organization, development and conduction of personal and reciprocal protection.

31.2. Municipalities cooperate with each other, during accomplishment of protection duties against natural and other disasters; during these efforts join means and services in accomplishing common issues concerning natural and other disasters.

Article 32

32.1. Enterprises and other institutions should provide conditions and opportunities for realization of personal and reciprocal protections as well as realization of protective measures set forth by this Law.

32.2. Enterprises and other Institutions which during the work process use, produce, and transport and deposit hazardous materials such are: oil and its derivatives and energetic gasses and make the realization of the activity by the hazardous means are required to establish emergency action and protection plan in accordance with legal provisions.

32.3. Other enterprises and institutions, from paragraph 2 of this Article, at their own expense are obligated to establish and maintain equipment for intervention, to organize sufficient forces for protection and rescue, to provide information and alarming of workers and population about the danger, always having in mind the scale of danger, which may result from their activity.

32.4. Government, by special act, determines the classification, label and quantity of dangerous materials as well as activities and means from paragraph 2 of this Article.

Article 33

33.1. Owners and users of dwelling premises are responsible to undertake determined protection measures and to provide sufficient means for protection, rescue and aid.

33.2. Owners or users of cultural inheritances are responsible to undertake foreseen protection measures. They can also ask help from Institutions for protection of cultural inheritances.

33.3. Owners or users, based on paragraph 1 of this Article should give to the competent authority for protection from natural and other disasters, all existing records of premises and users of these premises.

V. PROGRAMMING AND PLANNING

Article 34

34.1. The research and development project for protection from natural and other disasters is an integral part of governmental programs for research.

34.2. DEM participates during decisions on research project and development of governmental programs for research, and proposes research projects concerning development of the field of natural and other disaster protection.

34.3. DEM, after prior unification with relevant ministries for research activities may finance the research and development projects related to natural and other disaster prevention with its own means.

Article 35

35.1. The Governmental program for protection and rescue from natural and other disasters determines the aim, policy and protection and rescue strategy from natural and other disasters, for at least 5 years.

35.2. The Governmental program contains as following:

i.       Risk assessment and determination,

ii.       Safety situation in regard to the natural and other disasters,     

iii.      Determination of protection scale against specific natural and other disasters,

iv.      Basic aims, protection duties and the ways for achievement,

v.       Resume of preventive measures,

vi.      Directions of science politics, investigation and development

vii.     Directions for organization of forces and means for protection, rescue and aid,

viii.   Directions for development of educational programs,

ix.      Analysis and pre-account expenses.

Article 36

Duties of governmental program are detailed in the annual protection and rescue plan against natural and other disasters.

Article 37

All programs in municipal level for protection and rescue from natural and other disasters cannot be in disagreement with the governmental programs.

Article 38

38.1. Planning of protection, rescue and aid against natural and other disasters and emergency situation should be based on evaluation of the danger.

38.2. Danger evaluation within country as far as natural and other disasters and emergency state are concerned is done by DEM.

38.3. Danger evaluation for territory of municipality shall be made by MDPR. 

38.4. Government determines methodology for evaluation of the danger.

38.5. MIA issues Administrative Instruction for preparing of general plan for protection, and rescue against natural and other disasters.

Article 39

Protection and rescue plans should be supplemented in case of alteration of danger scale or change of forces and existing means for protection, rescue and aid, at least once a year.

VI. UNIQUE SYSTEM FOR ALARMING AND EMERGENCY COORDINATION

Article 40

40.1. The Unique System for Alarming and Emergency Coordination (hereinafter USAEC), shall be ensured warning and efficient and timely information of the citizens regarding natural and other disasters.

40.2. USAEC provides correct and timely information of all emergency services (KPC, KPS, hospital and prehospital emergency centers and municipal services, municipal fire brigade and hospital emergency centers in municipalities) as well as humanitarian local and international associations, agencies and specialized associations in the field of emergency.

40.3. USAEC has the identification number 112, and is unique for the whole Kosovo territory.

40.4. USAEC is organized in central and municipal level.

40.5. USAEC shall provide communication and coordination in case of natural and other disasters, with neighboring countries, regions and wider.

40.6. Functional organization and the scope of USAEC shall be regulated with Administrative Instruction approved by the Government.

VII. PREVENTIVE MEASURES

Article 41

Preventive measures are:

i.    Environmental, urban, constructing and other technical measures;

ii.    Evacuation;

iii.   Reception and supply for endangered population;

iv.   Radiological, chemical and biological protection;

v.    Shelter;

vi.   Protection of cultural and natural heritage.

Article 42

42.1. Environmental, urban planning, construction and other technical measures are undertaken during planning of living environment, during construction of buildings aiming the prevention and reduction of natural and other disasters as well as to enable protection, rescue and aid.

42.2. Projects for construction of buildings, designated for collective use, supply of the population, public transport, as well as disposal, production and use of dangerous materials, oil and its derivatives, energy gases should contain security elaborates against natural and other disasters.

42.3. Government with Administrative Instruction determines the type of objects pursuant to paragraph 2 of this Article and environmental, urban and constructive and other technical measures of protection against natural and other disasters.

Article 43

43.1. Evacuation of the risked population is done, when the other measures cannot ensure their safety.

43.2. Decision for evacuation is taken by the Government, Mayor of Municipality and competent commander of PPR against natural and other disasters.

43.3. From zones where the evacuation is foreseen, the citizens shall be moved to the predetermined place and in predetermined time and manner which is stated in the plan for protection, rescue, respectively with the order of competent authority.

43.4. Displacement of population to another municipality cannot effect in aggravation of their legal status.

43.5. Municipality from which region the population has been evacuated covers the expenses of accommodation, as well as supply, education and health care.

43.6. Expenses from paragraph 5 of this Article are compensated to the municipality by the Government, respectively municipalities from where the evacuated population is.

Article 44

44.1. In accordance to this Law, Government and municipalities should provide shelter and necessary supply to the population, who are left homeless and without elementary means for living due to the natural and other disasters.

44.2. The Mayor of the Municipality, in specific cases, suggests that the owners or users of dwelling buildings, can temporary accept evacuated population and endangered persons, based on paragraph 1 of this Article, if their accommodation cannot be solved in another way.

Article 45

45.1. Radiological, chemical and biological protection contains measures and means for direct protection against radiological, chemical and biological weapons and consequences of disasters resulting from dangerous materials.

45.2. Owners or users of dwelling buildings, which are designated for public supply, transport and storage of food items, medical supplies and animal food as well as public and health services, care and children's education, shall provide the protection means and undertake appropriate measures for radiological, chemical and biological protection.

45.3. Government by an Administrative Instruction regulates the organization of radiological, chemical and biological protection and determines the actions and measures of protection, based on paragraph 2 of this Article.

Article 46

46.1. For initial shelter of people shall be used public shelters; in fact for this aim appropriate buildings shall be adapted.

46.2. Municipality is responsible for public shelters.

Article 47

47.1. Shelters for initial shelter should provide protection against crushes, ruins, radioactive rains, fire and effects of chemical materials.

47.2. Shelters for additional protection should provide protection from building collapse.

Article 48

48.1. Municipality and users should maintain shelters in condition that meet the demands for use.

48.2. Alterations are not allowed for shelters, if those alterations reduce the function of protection.

Article 49

49.1. Investors should build shelters with their own means.

49.2. Investor of public shelters is the municipality.

49.3. To speed the construction of shelters, government should accept guarantees or allow subventions.

49.4. The municipality determines the location and premises where shelters should be built as well as conditions for their construction and maintenance.

49.5. The government decides for acceptance of guarantees and distribution of subventions.

49.6. The government, with an administrative instruction arranges technical normative for shelters and adoption of buildings for shelter.

Article 50

50.1. Protection of cultural and natural heritage means preparation for accomplishing of measures concerning the reduction and prohibition of negative effects from natural and other disasters in cultural and natural heritage.

50.2. Preparation and measures under paragraph 1 of this Article are accomplished by owners or users of cultural and natural heritage as well as municipalities and government.

50.3. During accomplishing of protection concerning cultural and natural heritage against natural and other disasters relevant service units of Civil Protection, fire brigades, and other forces for protection, rescue and aid are engaged as needed.

50.4. Government of Kosovo by Administrative Instruction regulates the protection of cultural and natural heritage against natural and other disasters in conformity with the legislation in power.

VIII PERSONAL AND RECIPROCAL PROTECTION

Article 51

51.1. Personal and reciprocal protection includes measures that population should undertake in order to prevent and reduce consequences from natural and other disasters, concerning their health and safety of their property based in the plan for protection and rescue.

51.2. Government foresees means and equipments for personal and reciprocal protection in case of natural and other disasters, which should be available to the population, owners or users of premises, economical enterprises, institutions and other organizations as well as government authorities.

IX. FORCES FOR PROTECTION AND RESCUE AGAINST NATURAL

AND OTHER DISASTERS

Article 52

Protection, rescue and aid in case of natural and other disasters include:

i.       First medical aid;

ii.       First veterinary aid;

iii.      Extinguishments and rescue of fire;

iv.      Rescue from ruins, avalanches, slides (earth, snow);

v.       Rescue from floods, weather catastrophes, ecological disasters and other disasters of rivers and lakes;

vi.      Rescue on the mountains;

vii.     Rescue on waters;

viii.     Rescue from serous traffic accidents;

ix.      Rescue from mine accidents;

x.      Safety from explosive and unexploded means;

xi.      Accomplishment of radiological, chemical, biological protection in case using dangerous materials;

xii.     Providing elementary conditions for life.

Article 53

Forces for protection and rescue from natural and other disasters are the following:

i.    Units of for protection and rescue against natural and other disasters;

ii.    Units, services and operative components of associations and non-governmental organizations;

iii.   Economical enterprises and institutions;

iv.   Kosovo Protection Corps;

v.    Kosovo Police Service and UNMIK Police;

vi.   KFOR.

Article 54

54.1. Units, services and other operative components of non government associations and organizations accomplish duties of protection, rescue and aid, respectively public services based on the decision of competent authority of local community or municipal and government authority, if it meets the foreseen conditions.

54.2. Competent authority decides for:

i.    Composition, capacity and the way of performing duties, respectively public services;

ii.    The beginning to accomplish duties in emergency cases;

iii.   Financial means, which are provided by municipality, respectively by government in accomplishing duties in emergency cases;

iv.   Financial means for payment of compensation in accordance with this Law for citizens, who are affected by the intervention and professional illness;

v.    Supervision of duty accomplishment in emergency cases.

Article 55

Public services for protection, rescue and aid are:

i.    Service of fire protection and rescue, which is performed by the fire units in accordance with law on fire protection;

ii.    Service of mountain rescue, which is accomplished by mountain associations of Kosovo in accordance with competent government authorities;

iii.   Services for protection, rescue and aid in case of ecological and other disasters.

iv.   Medical emergency units,

v.    Other professional services

Article 56

56.1. To accomplish operative duties from the field of protection, rescue and aid, competent government or municipal authority may designate enterprises, or institutions that possess means and appropriate staff.

56.2. Enterprises and institutions from paragraph 1 of this Article determines the organization of duty accomplishment; take care for professional promotion of their employees and accomplish activities and other preparation in order to act in case of natural and other disasters.

56.3. MDPR, competent authority of municipality or government authority, enterprises and institutions, which are determined in accomplishment of duties of protection, rescue and aid, ensuring also compensation of their real expenses for participation in accomplishment of duties and realization of preparations, which exceed their usual activities.

Article 57

57.1. In order to accomplish duties of protection, rescue and aid, shall be organized the units and services for force of protection and rescue from natural and other disasters as follows:

i.       Units for First medical aid;

ii.       Units for First veterinary aid;

iii.      Technical rescue units;

iv.      Units and services for radiological, chemical, biological protection;

v.       Logistic units;

vi.      Units for evacuation and shelter;

vii.     Units for conciliation of terrain;

viii.     Units for protection of plants;

ix.      Units of deactivating unexploded items; and,

x.      Units for fire extinguishing

57.2. Government, municipality, economical enterprises and other institutions, organize service units from paragraph 1 of this Article in accordance with the criteria for organizing, completion and preparation of protecting forces from natural and other disasters, which are determined by Government.

Article 58

58.1. Protection from unexploded ordinances consists on detecting, securing, removing transporting and their destroying.

58.2. Members of protection units against unexploded ordinances perform these duties based on paragraph 1 of this Article if they are authorized by the Government.

58.3. Protection from unexploded ordinances is regulated by a specific rule issued by the Government.

Article 59

59.1. The Government decides for, engagement of protection and rescue forces from natural and other disasters and other forces of protection rescue and aid.

59.2. In local level the Competent Committee for protection and rescue, decides for activating of protection, rescue and aid forces in case of natural and other disasters, whereas in central level the Inter Ministerial Committee for protection and Rescue.

Article 60

The KPS is in charge of keeping public order, peace and safety in case of natural and other disasters in affected regions.

X. ADMINISTRATION AND LEADERSHIP

Article 61

61.1. Management of forces of protection, rescue and aid, are organized and perform as a unique system.

61.2. Management, based under paragraph 1 of this Article, is executed by relevant committees and leaders of units for protection, rescue and aid.

61.3. Management relies on obligatory completion of tasks and decisions of competent authorities in conducting forces of protection, rescue and aid.

Article 62

Units, services and other compositions of non-governmental organizations and associations, which participate in protection, rescue and aid, are conducted by their leaders in accordance to the rules that are foreseen by this Law.

Article 63

If Kosovo Protection Corps (KPC) units are engaged in the process of protection and rescue they are lead by their Superior officer, in agreement with the directions by the competent commander of the incident.

Article 64

Duties of the Commander of the Incident are the following:

i.       Verifies preparedness and intervention of forces and means for protection, rescue and aid,

ii.       In case of a disaster coordinates protection, rescue and aid,

iii.      Takes care for activity and coordination of all forces for protection, rescue and aid,

iv.      In place of disaster stop entrance for unauthorized persons,

v.       From damaged zones and objects, order the evacuation of human beings, animals and property,

vi.      Allow using of intercommunication equipments, respectively their placement,

vii.     Order the moving away of barriers, that bloc the intervention,

viii.     To allow the use of borrowed transport means for transportation of injured, respectively necessary means for protection, rescue and aid,

ix.      Orders obligatory participation of citizens for rescue according to their abilities and adequate rescue equipment,

x.      To allow the use of borrowed land, which necessary for protection, rescue and aid,

xi.      To order the destruction of the building or eliminate obstacles.

xii.     To coordinate activities of foreign agencies, and

xiii.    Informs and authorizes disclosure of information for the media.

Article 65

If there is a need for forces and means from neighboring municipality, concerning protection, rescue and aid, then the Commander of the incident recommends the committee to request aid from the other municipality.

Article 66

66.1. Committees of forces for protection are established for management and execution of the operative professional duties of protection, rescue and aid.

66.2. Committees of forces for protection are:

i. Kosovo Inter ministerial Committee for Protection and Rescue;

ii. Municipal committees for protection and rescue;

iii. Committees of enterprises and other institutions.

66.3. The committee is commended by the head of the committee and in case of his/her absence, his deputy.

66.4. The committee has designated number of members, who are appointed from different occupations and represent authorities, organizations and services that participate in protection, rescue and aid in accordance with the plan for protection and rescue.

Article 67

67.1. In the forces for protection, rescue and aid of Kosova following signs are used:

i. Member sign of Kosova forces for protection, rescue and aid,

ii. Signs of position (grade),

iii. Signs of unit's specialty and services.

67.2. Reproduction or unauthorized use of signs and uniforms of Kosova forces for protection, rescue and aid is prohibited.

67.3. The Government by an administrative instruction decides for signs, type, form and protection of uniforms of Kosova forces for protection, rescue and aid.

Article 68

68.1. During performance of duties a member of Kosova forces for protection, rescue and aid wear uniform, appropriate sign and identity card.

68.2. Member of units, services and other operative compositions of non-governmental associations and organizations, enterprises, and other institutions during performance of protection, rescue and aid in the state of emergency, in addition to their signs use signs of corresponding forces for protection, rescue and aid of Kosova.

Article 69

69.1. For exceptional achievements in the field of protection and rescue from disasters acknowledgements and awards are given to:

i.    Contribution in preventing risks;

ii.    Contribution in accomplishing duties in protection, rescue and aid;

iii.   Courageous activities;

iv.   Invention and innovation;

v.    Achievements in development and research;

vi.   Achievements in education and improvement;

vii.  Notable work in the field of security against natural and other disasters.

69.2. Government by an administrative instruction foresees acknowledgements and awards, based on paragraph 1 of this Article.

Article 70

In the field of protection and rescue against natural and other disasters the Kosova Assembly:

i.    Determines basic directions in organization and execution of protection and rescue against natural and other disasters,

ii.    Approves the plan of protection and rescue against natural and other disasters,

iii.   Supervises implementation of the plan for protection and rescue against natural and other disasters,

iv.   Decides for providing means and other needs to eliminate consequences of extraordinary natural disasters, and

v.    Adopts the plan of functioning and development of forces for protection, rescue and aid.

Article 71

In the field of protection and rescue against natural and other disasters the Government of Kosova:

i.   Directs and harmonizes the organization, preparation and execution of natural and other disasters in Kosova.

ii.    Proposes the plan for protection and rescue against natural and other disasters.

iii.  Directs protection, rescue and aid as well as actions for elimination of consequences from extraordinary natural and other disasters.

iv.  Administrates International Aid in case of natural and other disasters.

v. Appoints committee for evaluation of damages in case of natural and other disasters.

vi. Informs the Kosovo President and Kosovo Assembly on natural and other disasters, consequences and undertaken measures for preventing them.

Article 72

72.1. Members of committee for evaluation of damages form point (v) of Article 71 of this law are appointed within the ranks of experts and representatives of central and municipal administration, enterprises, institutions and security companies.

72.2. The damaged people gather records for the damages that resulted from natural and other disasters, which they will present to competent Committee for evaluation of damages.

72.3. Committee evaluates material damages and consequences from natural and other disasters, based on methodology that is determined by the Government.

Article 73

Municipal Assembly in the field of protection and rescue against natural and other disasters:

i.    Is in charge of execution of preparations for protection against natural and other disasters;

ii.    Takes care in undertaking measures to prohibit and reduce consequences from natural and other disasters;

iii.   Directs protection, rescue and aid and elimination of consequences from natural and other disasters;

iv.   Designates the Commander and establish the Committee for Protection and Rescue against natural and other disasters.

Article 74

74.1. Government directs and coordinates the activities of ministries in the field of protection and rescue against natural and other disasters.

74.2. Ministries are responsible for realization of measures for preventing natural and other disasters, respectively their consequences in their field of activity.

74.3. Ministries are responsible for the state of preparation in realization of the activities from their competences in case of natural and other disasters.

74.4. Government duties, ministries and government services for protection, rescue and aid are detailed in the plan of protection and rescue against natural and other disasters.

Article 75

The DEM executes professional and administrative duties of security against natural and other disasters, as follow:

i.       Composes proposals for research and development projects for protection and rescue against natural and other disasters.

ii.       Composes proposals for the plan of protection and rescue against natural and other disasters.

iii.      Looks after organizing and functioning of system of monitoring, informing and alarming.

iv.      Composes the evaluation of danger and other professional basis, concerning planning of protection, rescue and aid, as well as harmonization of measures for prohibition and reduction of consequences from natural and other disasters in cooperation with other ministries.

v.       Observes and inform the danger of natural and other disasters and gives instructions for action in cooperation with ministries and government services.

vi.      Organizes, completes and trains central units and services of Protection and rescue against natural and other disasters and other forces for protecting, rescue and aid;

vii.     provide working conditions for IMCPR against natural and other disasters headquarters and also central committee for damage evaluation.

viii.     Observes and coordinates organizing of protection and rescue against natural and other disasters and other forces of protection, rescue and aid.

ix.      Prepares programs, organizes and execute education and training for protection, rescue and aid.

x.      Creates and maintains reserves of government material means for use in cases of natural and other disasters.

Article 76

MDPR is responsible for executing professional and administrative duties in the field of security against natural and other disasters in its own territory, and:

i. Compiles the plan for protection and rescue against natural and other disasters in accordance with administrative instructions from competent government authority;

ii.  Assesses the risk based on the exact records for planning and undertakes preventive measures to prohibit, reduce and eliminate consequences of natural and other disasters;

iii. Proposes establishment of units of protection and rescue against natural and other disasters as well as accomplish their supplement with obligators and completes them with adequate means for acting in natural and other disasters cases;

iv. Prepares programs for training in accordance with government authority;

v. Looks after providing and maintaining reserves of material means in case of natural and other disasters;

vi. Organizes the function of monitoring, informing and alarming system;

vii. Perform other works in the field of protection and rescue against natural and other disasters, in cooperation with competent municipal and government authorities.

Article 77

77.1. Administrative authority in enterprises and other institutions:

i.  Takes care for accomplishment of preparations for protection, rescue and aid,

ii. Directs protection, rescue and aid in case of natural and other disasters;

77.2. For professional-operative leadership of protection forces, concerning protection, rescue and aid, the authority appoints the commander and committee for protection, rescue and aid in case of natural and other disasters, based on paragraph 1 of this Article.

XI. INSPECTORATE

Article 78

78.1. Inspectorate of Kosova for protection and rescue against natural and other disasters (hereinafter Inspectorate) performs supervision of the realization of provisions of this Law and other provisions, which regulate security against natural and other disasters.

78.2. Inspectorate shall function as a unit in DEM, and for its function, the competences and duties shall be issued by an administrative instruction by the Government.

78.3. Inspectors, during performance of inspection verify:

i.    The undertaking of measures to prevent, reduce and eliminate consequences of natural and other disasters;

ii.    The state of the plans and other preparations for protection, rescue and aid;

iii.   Accomplishment of duties of monitoring, informing and alarming;

iv.   Training, completion and preparation of units and services for protection and rescue against natural and other disasters and other forces in protection, rescue and aid;

v.    Realization of training program for protection, rescue and aid;

vi.   Completion of administrative and professional works in the field of protection against natural and other disasters.

78.4. Inspectorate determines practical verification, based on paragraph 2 of this Article.

78.5. Municipal inspectors of protection and rescue against natural and other disasters, perform the duties within municipality territory, based on paragraph 3 of this Article.

Article 79

79.1. Inspectorate, apart from general competences of inspection, has other competences and obligations:

i.  To determine interruption of activity until final decision of the competent authority, respectively for use of the premises, equipment, engines, means of transport with technological activities, use of material and other means, if there is a direct danger for any disaster;

ii. Orders by decision that in determined period of time or determined manner the elimination of verified deficiencies or inconsistency with rules, plans and decisions of competent authorities for protection, rescue and aid. 

79.2. Based on paragraph 1 of this Article, complaint request against decision of inspectorate can be submitted to competent authority, within 15 days, beginning from the date of deliverance, which doesn't interrupt its execution.

XII. PROFESSIONAL WORK AND INSURANCE AT WORK

Article 80

80.1. For workers of protection and rescue against natural and other disasters are valid rules for workers in civil administration, if not foresee otherwise by the Law.

80.2. Worker, who professionally perform duties the field of Protection and rescue against natural and other disasters, according to the decision of supervisor, should perform duties in particular conditions.

80.3. Particular conditions are:

i.       Work on Sundays and during holidays;

ii.       Work with separate schedule;

iii.      Long working hours;

iv.      Guardianship as normal work, respectively guardianship, which is determined in particular cases;

v.       Field work and time limited work;

vi.      Work in contaminated areas and other conditions that may risk health and life;

vii.     Permanent readiness for work in accordance with official needs,

viii.   Interruption of leave in accordance to official needs.

80.4. If an employee is engaged in guardianship or preparedness for work, the hours of work are calculated as work with extended schedule.

80.5. If the employee exceeds weekly or monthly obligations of work schedule, the difference is calculated as work with extended schedule.

80.6. Work in particular circumstances is considered the work, which has the risk from natural and other disasters.

Article 81

81.1. During performing the work in protection and rescue against natural and other disasters general rules concerning employees' safety at work are applied.

81.2. Government determines measures and activities to guarantee safety and the Protection and rescue against natural and other disasters employee's health as well as members of units, services and other operative compositions of non-governmental associations and organizations.

Article 82

82.1. Workers of protection and rescue against natural and other disasters during the strike should provide:

i. Continuous activity of system monitoring, informing and alarming and communication system;

ii.  Continuous accomplishment of professional- operative duties for functioning of committees for protection and rescue against natural and other disasters, respectively other authorities that conduct protection, rescue and aid.

82.2. Workers, based paragraph 1 of this Article have no right to strike during natural and other disasters or if the danger from natural and other disasters is informed in advance.

82.3. During the strike it is not allowed to use alarm signals as well as other equipments and means of protection, rescue and aid.

XIII. EDUCATION AND TRAINING

Article 83

For members of protection and rescue against natural and other disasters elementary and secondary level training is organized.

i.   In elementary education initial knowledge of risks from natural and other disasters as well as protection against these disasters are learned.

ii.  In lower and secondary education the knowledge for protection and rescue against natural and other disasters are learned in accordance with appropriate educational program.

Article 84

Training of protection and rescue against natural and other disasters members for realization of duties from this field includes basic and additional training.

i.   Basic training of protection and rescue against natural and other disasters members may last mostly 15 days, whereas additional training mostly 5 days per year,

ii.  Basic training may last more than foreseen by paragraph 1of this Article, according to the decision of competent authority,

iii. Additional training of protection and rescue against natural and other disasters members, based on regulations, is organized on free days,

iv. Members of protection and rescue against natural and other disasters receive the invitation at least 8 days prior to training commence.

Article 85

85.1. Members of protection and rescue against natural and other disasters can cancel their professional training by request, if:

i.  Due to illness or injury cannot participate in training,

ii. Looks after the sick person of his/her family.

85.2. Professional training can also be canceled due to official needs and seasonal agriculture works.

85.3. The request for cancellation should be submitted within 8 days, beginning from the date when invitation is received.

Article 86

86.1. The Government of Kosova establishes the Centre for Professional Training (herein after: the Centre).

86.2. This center, based on paragraph 1 of this Article, executes the program of training for members of protection and rescue against natural and other disasters, members of units, and other operative compositions, non-governmental associations, economical enterprises and other institutions.

86.3. The organization and function of the Centre shall be regulated by an administrative Instruction issued by the Government.

XIV. FINANCING

Article 87

Protection and rescue forces against natural and other disasters are financed by:

i.  Kosovo Consolidated Budget;

ii. Voluntary donations;

iii. International aid;

Article 88

88.1. Budget of Kosova provides means for administrative and professional finance, supervision, and other safety duties concerning natural and other disasters that are within competences of Government.

88.2. The government and municipalities, in consistency with its competences, provide financial means to cover expenses during accomplishment of protection, rescue and aid, as well as protection of health, people's lives, animals, property and environment.

88.3. The enterprises, and other institutions, that according to this Law should organize protection and rescue against natural and other disasters and undertake other measures for safety against natural and other disasters, guarantee means concerning workers' salaries during their training, as well as means for preparation and other training expenses.

Article 89

89.1. Aid means during elimination of damages and other consequences from natural and other disasters are provided from Budget of Kosova.

89.2. The proposals for the use of means, according to the paragraph 1 of this Article, are prepared, on the base of evaluation and proposal, the government committee concerning the evaluation of damages, nominated by the Government. The Government decides on the proposals of the Committee.

XV. ADMINISTRATIVE SANCTIONS

Article 90

90.1. Any physical or legal person, who performs an offence due to performance of his/her own activity, is fined for offence in the amount of at least from 1.000 € to 5.000 €.

i.    If he/she doesn't inform immediately the nearest center of information or the competent authority concerning the risk from natural and other disasters, (paragraph 2, Article 9).

ii.     If he/she doesn't perform, or in some way avoids realization of material obligation (Article 17 and 18).

iii.   If within the period of 15 days doesn't inform administrative authority for the change of records.

iv.    If he/she doesn't provide conditions or possibilities for realization of personal and reciprocal protection or workers, or doesn't accomplish foreseen protecting measures (from paragraph 1, Article 51).

v.    If in the process of work, he/she uses, products, transports or deposits dangerous materials, such as; oil and other derivatives, energetic gases, perform or use dangerous tools which present risk for accident occurrence, or doesn't evaluate the risk or plan for protection and rescue (paragraph 2, Article 42).

vi.   If he/she doesn't consider the size and percentage of risk and if with his own expenses doesn't perform and maintain preparation for intervention, doesn't organize necessary forces for protection and rescue, doesn't provide informing and alarming of employees or inhabitants concerning the danger of risk, or doesn't co-finance a part in enterprises, other institutions, that emerge from the risk, which they cause (Article 42).

vii.   If he/she is owner or user of apartment buildings and other premises and doesn't undertake foreseen protection measures or doesn't provide foreseen protecting means, concerning rescue and aid (paragraph 2, Article 45) as well as if he/she doesn't undertake foreseen protection measures for cultural and natural heritage (paragraph 2, Article 33).

viii.  If he/she is owner or user of apartment building and other premises and doesn't enable the activity of competent supervisor for protection and rescue and doesn't provide records of the building , or gathering of records for residents or other users of the building (paragraph 3, Article 33).

ix.    If he/she doesn't compose plans of protection against natural and other disasters.

x.    If as a owner or user of the buildings, equipments that are designated for public supply, productions, food transport and deposit, medical supplies, food for animals, public health services, maintenance, children's education doesn't offer protection for and also if doesn't undertake foreseen measures for radiological, chemical and biological protection (paragraph 2, Article 45).

xi.   If as an owner or user of shelters doesn't maintain them in accordance with foreseen condition for use, or in case of risk doesn't allow it for people, for whom the shelter is designated (paragraph 1, Article 48).

xii.   If he/she doesn't perform appropriate organizing to accomplish the duties, doesn't look after professional training of the employees, or doesn't undertake other preparation measures for acting in events of natural and other disasters (paragraph 2, Article 86).

xiii.  If he/she reproduces or illegally uses the signs and uniforms of Kosova force for protection and rescue against natural and other disasters, or uses in the traffic the same motor vehicles that are similar to transport motor vehicles of forces for protection and rescue against natural and other disasters (paragraph 2, Article 67).

xiv.  If he/she acts opposite to decisions of the inspector for protection and rescue against natural and other disasters (paragraph 1, Article 79).

90.2. Any responsible or legal person will be fined for offence in the amount of 250 € if he/ she acts opposite to item (xiii) of this Article.

Article 91

Any responsible person of government or municipal authority will be punished for offence in the amount of at least 800 € to 1.500 €:

i.   If competent government or municipal authority doesn't perform evaluation of risk in its own field (item (iv) of Article 75 and item (ii) of Article 76).

ii.  If competent municipal authority doesn't perform municipal plan of Protection and rescue against natural and other disasters (item (i) of Article 76).

iii.  If acts as in articles vii, viii, ix, x, xi, xii of Article 90 of this Law.

Article 92

With penalty for offence in amount of 500 Euros is fined the individual:

i. If he/she doesn't accomplish or avoids accomplishment or participation in forces for protection and rescue against natural and other disasters (Article 10).

ii. If he/she doesn't accomplish material obligations, which means to give for protection and rescue against natural and other disasters motor vehicles, engines, equipments and other material means, land, buildings, devices, energetic sources, which are necessary for protection, rescue and aid in emergency cases (paragraph 1, Article 17).

iii. If he/she prohibits or removes from business and other premises the equipments or devices for monitoring, informing and alarming (paragraph 2, Article 17).

iv. If he/she doesn't respond to the call of competent authority, or without any justification doesn't appear in the pre determined location as well as doesn't deliver his/her material device (paragraph 2, Article 18). 

v. If as owner or user of the apartment building opposes the order of the President and doesn't accept to shelter temporarily evacuated or risked people (paragraph 2, Article 44). 

vi. If he/she accomplishes the action from items i, iii, vii, viii, xi and xiv of Article 90 of this Law.

XVI. FINAL PROVISIONS

Article 93

The authorities determined by this law shall be obliged to issue the sub legal acts foreseen  by this law, not later than one year after the entry into force of this law.

Article 94

This law abrogates all provisions of the applicable law that is not in compliance with.

Article 95

The present law shall enter into force after adoption by the Assembly of Kosova on the date of its promulgation by the Special Representative of the Secretary-General.
